Eligibility and estate recovery are different questions.

Asset limits and transfer rules depend on the Medi-Cal program. A transfer for less than fair value can affect long-term-care coverage. Start with the DHCS asset-limit and transfer FAQs and review your circumstances before acting.

What about the family home?

A home may be excluded when evaluating eligibility, but that does not settle the separate estate-recovery question. For deaths on or after January 1, 2017, DHCS limits recovery to specified benefits and assets subject to probate. Exemptions and hardship waivers may apply. See the DHCS Estate Recovery Program.

Review trusts and transfers individually

A trust or deed change is not a universal solution. Review ownership, decision-making authority, care needs and the effect of a proposed transfer before signing. The consultation identifies options and further work; it does not guarantee eligibility, avoidance of recovery or a protected inheritance.

Are Medi-Cal eligibility and estate recovery the same question?

No. Eligibility concerns whether a person qualifies for benefits; estate recovery concerns certain claims after death. A planning review should address both, using the person’s program, care needs, ownership, family circumstances and the rules applicable at the relevant time.

What should I bring to a Medi-Cal planning consultation?

Bring benefit notices, application or renewal dates, current care arrangements, a summary of assets and income, existing estate documents, property ownership information and any transfer history. Discuss proposed gifts or ownership changes before taking action.
